Here are a few questions that could literally save your company millions of dollars:

1. Would you store millions of dollars of inventory in a warehouse without fire insurance?

2. Would you let your company trucks go on the road with unlicensed drivers, or without vehicle liability insurance?

3. Would you let your employees operate forklifts, order pickers, front end loaders and other materials moving equipment without them being OSHA certified as operators?

The answers to the first two are obvious. The risk of exposure wpeD1.gif (11043 bytes) would be totally unacceptable. Yet many companies continue to answer yes to the third question, thereby exposing themselves to indefensible lawsuits, lost time, equipment and inventory damage, increased workman's compensation claims, higher insurance costs and fines from regulatory agencies.

All this in spite of the fact that both OSHA and CAL-OSHA require such certification, even for experienced operators. Fines for non-compliance are set by law at a minimum of $500 up to a maximum of $14,000 per violation. FOR MINOR WILLFUL VOLATIONS. SB 1127 passed in California in July 2000, has provisions for penalty for serious willfull violations. They include for the operator a $3,000.00 fine and/or 3 months in jail. For the supervisor: $6,000.00 Fine or six months in jail. For the employer: up to $14,00.00 fine per day until date of hire or July 2000, whichever is later. Covered industries include General Industry, Construction, Shipyards, Marine Terminals and Long shoring Operations. Agricultural operations are exempt, although Ag product processing and distribution centers are not exempt. Covered equipment includes (but is not limited to)  fork trucks (forklifts), tractors, platform lift trucks, motorized hand trucks and other specialized industrial trucks powered by electric motor or internal combustion engine, cranes, semi-tractors, top loaders and even electric pallet jacks.
